Musannaf Ibn Abi Shaybah

Hazrat Ikrimah says: When a Muhrim touches his wife (with desire) or winks at her, there is expiation upon him; he will give charity on his behalf.

Hazrat Ata says: For a Muhrim, touching or feeling his wife once from behind a cloth does not incur anything upon him, but if he touches or feels her several times, then a Dam (sacrificial penalty) is due upon him.

Hasan was asked: If a person has intercourse with his wife while in the state of Ihram? He replied: A camel is obligatory upon him. Yunus says: I asked, what if ejaculation occurs? He used to say: That is also considered as intercourse; he must perform Hajj again the following year.

Hazrat Ghailan bin Jarir says that I and Hazrat Hakam bin al-Darim were present when a person came to us and said: I had placed my hand on a part of my wife and I became in a state of janabah (ritual impurity). We said, we do not know anything about this; let us go to our Hazrat Saad Ali (may Allah be pleased with him) bin Abdullah al-Bariqi. Then we went to him and inquired about it. He said, I do not know anything about this. Meanwhile, we saw Hazrat Jabir bin Zaid, so I said, this is Abu al-Sha’tha, go to him and ask him, then also inform us. That person went to him and asked him, then he came back to us with signs of happiness on his face, and said, he has told me to keep it concealed. Thus, we think that he has instructed him to perform dam (expiation).

It was asked from Hasan and Hazrat Ata: A man touched a woman and had an ejaculation. Both of them said that he must give a camel and perform Hajj the following year.

It was asked from Hazrat Ata that if a Muhrim had intercourse with his wife and he ejaculated, he replied: I think the same is obligatory upon him as is upon one who has intercourse.
