Hadith 10371
١٠٣٧١ - حدثنا (أبو بكر) (١) قال: (حدثنا) (٢) ابن مبارك عن ابن جريج عن عطاء في الزرع يكون على (السيح) (٣) الزمان ثم يسقى (بالبئر) (٤) يعني (بالدلو وبالدالية) (٥)، قال: يصدق على أكثر ذلك (أن) (٦) يسقى به.
It is narrated from Hazrat Ibn Jurayj that Hazrat Ata was asked: If a field is irrigated for some time with running water and then irrigated by drawing water from a well with buckets, what is the ruling of zakat on that land? He replied: The method by which it was irrigated for the longer period will be considered.
Hadith 10372
١٠٣٧٢ - حدثنا محمد بن بكر عن ابن جريج قال: قلت لعطاء إنما يكون (على العين) (١) عامة الزمان، ثم (يحتاج) (٢) إلى البئر في (القطعة) (٣) يسقى بها، ثم (القطعة) (٤)، ثم (يصير) (٥) إلى العين كيف صدقته؟ قال: (العشر) (٦)، (وقال) (٧) يكون ذلك على أكثر ذلك أن يسقى به، إن كان يسقى بالعين أكثر مما يسقى بالدلو ففيه العشر، وإن كان يسقى بالدلو أكثر مما يسقى (بالنجل) (٨) ففيه ⦗٢٢٩⦘ نصف العشر، قلت: هو بمنزلة ذلك، أيضا المال يكون بعلا أو (عثريا) (٩) (عامة) (١٠) (الزمان) (١١) ثم يحتاج إلى (البئر) (١٢)؟ قال: نعم.
Hazrat Ibn Jurayj says that I asked Hazrat Ata: If a piece of land is irrigated for some time with running (spring, etc.) water, then there arises a need to irrigate a part of it with well water, and then another part is irrigated again with spring water, how should its zakat be calculated? He replied: Ushr (one-tenth) is due. He said that the ruling will follow the method by which it was irrigated for the longer period; that is, if it was irrigated for a longer time with spring water rather than with buckets, then ushr is due on it. And if it was irrigated for a longer time with buckets rather than with spring water, then half-ushr is due on it. I asked: If some land is irrigated for some time with camels (i.e., by animal power) and rainwater, and then there arises a need to irrigate it with well water, is the ruling the same? He replied: Yes. Abu Zubair, the narrator, says that I also heard Ibn Umair saying the same, then I asked Salim ibn Abdullah about it, and he answered like Ubaid.
