٣٩٠٥٣ - حدثنا يحيى بن سعيد عن أبي جعفر الخطمي قال: بعثني عمي وغلاما له إلى سعيد بن المسيب فقال: ما تقول في المزارعة؟ فقال: كان ابن عمر لا يرى فيها بأسا حتى حدث (١) فيها بحديث أن رسول اللَّه ﷺ أتى بني حارثة فرأى زرعا في أرض ظهير فقال: "ما أحسن زرع ظهير"، فقالوا: إنه ليس لظهير قال: "أليست ⦗٢٧٨⦘ الأرض أرض ظهير؟ " قالوا: بلى، ولكنه زارع فلانا، قال: "فردوا عليه نفقته وخذوا زرعكم"، قال رافع: فأخذنا زرعنا ورددنا عليه نفقته (٢).
Hazrat Abu Ja'far Khatmi narrates that my uncle sent me and one of his slaves to Sa'id bin Musayyib to ask what he says about sharecropping (muzara'ah). He replied: Ibn 'Umar (may Allah be pleased with them both) saw no harm in it, until he was told this hadith about sharecropping: The Messenger of Allah (peace and blessings be upon him) went to Banu Harithah and saw crops in the land of Zuhair. People informed him that these crops did not belong to Zuhair. The Prophet (peace and blessings be upon him) said: "Is this land not Zuhair's?" The people said: "Why not (it is his), but so-and-so has cultivated it." The Prophet (peace and blessings be upon him) said: "Return to so-and-so his expenses and take your crops." Hazrat Rafi' narrates: We took our crops and returned his expenses to him. And (Imam) Abu Hanifah's opinion is mentioned that: He should uproot his crops.
