٣٨٨٦٦ - حدثنا ابن علية عن ابن عون عن نافع عن ابن عمر قال: أصاب عمر (أرضا) (١) بخيبر فأتى النبي ﷺ فسأله عنها فقال: أصبت أرضا بخيبر لم أصب مالا قط عندي أنفس منه، فما تأمرنا فقال: "إن (شئت) (٢) حبست أصلها، وتصدقت بها"، قال: فتصدق بها عمر غير أنه لا يباع أصلها ولا يوهب ولا يورث، فتصدق بها في الفقراء والقربى وفي الرقاب وفي سبيل اللَّه وابن السبيل والضيف، لا جناح على من وليها أن يأكل منها بالمعروف، أو يطعم صديقا غير متمول فيه (٣).
It is narrated from Hazrat Ibn Umar (may Allah be pleased with them both) that Hazrat Umar received a piece of land in Khaybar. So he presented himself before the Noble Prophet (peace and blessings be upon him) and asked him about that land, and said: "I have received such a land in Khaybar that, in my opinion, I have never received better wealth than this. What do you command me regarding it?" The Prophet (peace and blessings be upon him) said: "If you wish, withhold its corpus and give its benefit (i.e., its profit) in charity." The narrator says that Hazrat Umar gave it in charity. But this condition remained that its corpus was neither sold nor gifted, nor did it pass on as inheritance. Thus, Hazrat Umar gave its (profit) in charity to the poor, relatives, for the freeing of slaves, in the way of Allah, to travelers and guests. Whoever is the guardian of the endowment, there is no harm if he eats from it according to his need or feeds a non-wealthy friend from it.
