ما قالوا: في الوالي أله أن يقطع شيئا من الأرض؟Those Who Said: Does the Ruler Have the Right to Grant Ownership of Land?
Hadith 35240
٣٥٢٤٠ - حدثنا أبو معاوية عن الشيباني عن محمد بن عبيد اللَّه الثقفي قال: أتى عمر رجل من ثقيف يقال له: نافع أبو عبد اللَّه، قال: فكان أول من افتلى الفلا بالبصرة، (قال) (١): فقال: يا (أمير) (٢) المؤمنين (إن) (٣) قبلنا أرضًا بالبصرة ليست من أرض الخراج، ولا تضر بأحد من المسلمين، فإن رأيت أن (تقطعنيها) (٤) أتخذها قضبا لخيلي فافعل، قال: فكتب عمر إلى أبي موسى إن كان كما قال: فأقطعها إياه (٥).
Hazrat Muhammad bin Ubaidullah Al-Thaqafi (may Allah have mercy on him) narrates that a man from the tribe of Thaqif, whose name was Nafi’ Abu Abdullah, came to Hazrat Umar (may Allah be pleased with him). He was the first person who made the barren valley of Basra a pasture. He submitted: O Commander of the Faithful! There is a piece of land near us in Basra which is not land subject to Kharaj (tax), and it will not harm any Muslim if you deem it appropriate, then grant it to me so that I may grow grass there for my horses. Please do so. The narrator says: Hazrat Umar (may Allah be pleased with him) wrote a letter to Hazrat Abu Musa (may Allah be pleased with him): If the matter is as he has said, then grant that land to him.
