٣٥١٩١ - حدثنا عفان قال: ثنا عبد الواحد قال: ثنا أبو (طلق) (١) قال: (حدثنا) (٢) أبو حنظلة بن نعيم أن سعدا كتب إلى عمر: أنا أخذنا أرضا لم يقاتلنا أهلها، قال: فكتب إليه عمر إن شئتم أن تقسموها بينكم فاقسموها، وإن شئتم أن تدعوها فيعمرها أهلها ومن دخل فيكم بعد كان له فيها نصيب، فإني أخاف أن تشاحوا (فيها) (٣) وفي (شربها) (٤) فيقتل بعضكم بعضا، فكتب إليه سعد: أن المسلمين قد أجمعوا على أن رأيهم لرأيك (تبع) (٥)، فكتب إليه: أن يردوا الرقيق (إلا) (٦) امرأة حملت من رجل من المسلمين (٧).
Hazrat Abu Hanzala bin Naeem (may Allah have mercy on him) narrates that Hazrat Saad (may Allah have mercy on him) wrote a letter to Hazrat Umar (may Allah be pleased with him) saying that we have taken control of a region without fighting. What should we do now? Hazrat Umar (may Allah be pleased with him) replied to them in a letter: If you wish to divide this region among yourselves, then divide it, and if you wish, leave this region so that its inhabitants themselves will settle it. And if someone joins you in this region after you have received your share, then I fear that you will compete with each other in this matter and in the distribution of water, and then some of you will kill others. Hazrat Saad (may Allah have mercy on him) wrote a letter to him (may Allah be pleased with him) and said: Indeed, all the Muslims have agreed that their opinion is subject to your (may Allah be pleased with him) opinion. Hazrat Umar (may Allah be pleased with him) then wrote them a letter and said: Return the slaves to their women, even if any of them has become pregnant by a Muslim man.
