Musannaf Ibn Abi Shaybah

31048 - From Aban ibn Salih, from Mujahid (they said): Two women became jealous of each other over Haml ibn Malik ibn al-Nabigha, so one of them attacked the other with a tent pole and struck her, causing her to miscarry and she died. This was brought to the Messenger of Allah ﷺ, and he ruled that her blood money be paid by the killer’s ‘aqilah, and he ruled for the fetus a compensation of a slave, male or female. The father or uncle of the killer said: “Should compensation be paid for one who neither ate nor drank, nor cried out, nor made a sound? Such a one is to be neglected!” The Messenger of Allah ﷺ said: “He is saying the words of a poet. Yes, for him is a compensation of a slave, male or female.”
