Hadith 30992
٣٠٩٩٢ - حدثنا أبو بكر قال: حدثنا ابن إدريس عن (ابن جريج عن) (١) أبي الزبير عن جابر قال: قضى رسول اللَّه ﷺ (٢) (بالشفعة) (٣) في كل (شرك) (٤) لم (يقسم) (٥) ربعة أو حائط لا يحل له (أن يبيع) (٦) حتى يستأذن شريكه، فإن شاء أخذ، وإن شاء ترك، فإن باع ولم يؤذنه فهو أحق به (٧).
Hazrat Jabir narrates that the Messenger of Allah, peace and blessings be upon him, gave the ruling regarding every share which has not been divided, whether it is in the form of a house or a garden, that it is not permissible for the owner to sell it without the permission of his partner. So if he wishes, he will keep it, and if he wishes, he will leave it. And if the owner has sold it and did not inform the partner, then the partner has a greater right to that share.
