ما قالوا: إذا أخذ على سرقة (يقطع) أو لا؟Those Who Say: If a Slave Is Caught Stealing, Is His Hand Cut or Not?
Hadith 30053
٣٠٠٥٣ - حدثنا أبو بكر قال: حدثنا (هشيم) (١) عن أبي بشر عن يوسف (بن ماهك) (٢) أن عبدًا لبعض أهل مكة سرق رداء لصفوان بن أمية، فأتي به النبي ﷺ فأمر بقطعه، فقال: يا رسول اللَّه! تقطعه من أجل ثوبي؟ قال: "فهلا (قبل أن تأتيني) (٣) (به) " (٤) (٥).
Hazrat Yusuf bin Mahak narrates that a slave of someone from among the people of Makkah stole the sheet of Hazrat Safwan bin Umayyah. He was brought to the Prophet Muhammad (peace and blessings be upon him), and the Prophet (peace and blessings be upon him) ordered his hand to be cut off. Upon this, Hazrat Safwan said: O Messenger of Allah (peace and blessings be upon him)! Will you cut off his hand because of my garment? The Prophet (peace and blessings be upon him) said: Why did you not think of this before bringing him to me?
