٢٤٨١٣ - حدثنا أبو بكر قال: حدثنا جرير عن مغيرة عن حماد في رجل اشترى من رجل متاعا، فذهب يجيء (بحمال) (١) ينقله، فوجد صاحبه قد باعه، قال: إن وجد شيئًا بعينه أخذه، وإن كان قد ذهب فلم يقدر عليه فلا شيء له، وربحه الذي باعه.
It is narrated from Hazrat Hammad that a person bought goods from another, then went to fetch someone to carry the goods to carry the goods, and when he returned, the seller had already sold it further. So it was said that if the exact same item is available, he should take it from him. And if the second buyer has taken it away and the item is no longer available, then the first buyer has no claim. And the profit will belong to the seller; if he finds the exact same item, he should take it from him, and if it has been taken away and he is unable to retrieve it, then he has no claim, and the profit will belong to the seller.
