من كان يستحلف الرجل مع (بينته)Those Who Take an Oath Along with the Witness
Hadith 24574
٢٤٥٧٤ - حدثنا أبو بكر قال: حدثنا ابن أبي زائدة عن أشعث عن محمد قال: أقام رجل على رجل بينته، فقال خصمه: يمينه أحب إليَّ من شهوده، (فاستحلفه) (١) (رجل) (٢) فنكل فقال شريح: بئس ما (أثنيت) (٣) على شهودك، (ورد) (٤) شهادتهم.
It is narrated from Muhammad, may Allah have mercy on him, that a person presented witnesses against another. His opponent said: "I prefer his oath more than his testimony." Then he was asked to swear an oath, but he refused. Hazrat Shurayh said: "The praise you have given to your testimony is very bad, and their testimony is rejected." Hazrat Abdullah bin Utbah said: "I will not give you the right for which you will not take an oath."
