في الرجل يكفل الرجل ولم يأمرهA Person Becomes a Guarantor Without Permission
Hadith 24346
٢٤٣٤٦ - حدثنا أبو بكر قال: حدثنا (وكيع قال: حدثنا) (١) سفيان عن عبيدة ⦗٤٨١⦘ (بن) (٢) أبي صالح عن الشعبي قال: من كفل عن رجل بكفالة ولم يأمره بها فأداها عنه فليس للمكفول عنه شيء، إنما هي حمالة تحملها.
Hazrat Sha'bi (may Allah have mercy on him) says that if a person becomes a guarantor without permission or order and makes the payment on behalf of the guaranteed person, then nothing is obligatory upon the guaranteed person. It is the guarantor who has taken upon himself the burden that he has assumed.
