Hadith 24060
٢٤٠٦٠ - حدثنا أبو بكر قال: حدثنا ابن (عيينة) (١) عن عمرو عن إسماعيل الشيباني قال: (بعت) (٢) ما في رؤوس النخل إن زاد فلهم، وإن نقص فعليهم، فسألت ابن عمر فقال: نهى رسول اللَّه ﷺ عن ذلك إلا أنه قد رخص في العرايا (٣).
Ismail al-Shaybani says that I sold the tops of the trees on the condition that if they were more, then they would be theirs, and if they were less, then they would be upon them. Then I asked Hazrat Ibn Umar (may Allah be pleased with them both) about this. He (may Allah be pleased with him) said: The Messenger of Allah (peace and blessings be upon him) forbade this. He only permitted it in the case of 'Ariya.
