٢٣٤٨٦ - حدثنا أبو بكر قال: حدثنا جرير عن مغيرة عن الحارث: رجلين بينهما مال، فادعى الواحد نصفه وادعى الآخر الثلثين، قال: يعطى صاحب] (١) الثلثين نصف المال؛ لأن صاحب النصف قد برئ من النصف، (ويعطى الذي يدعي النصف الثلث؛ لأن صاحب الثلثين قد برئ من الثلث) (٢)، وبقي سدس (وكلاهما) (٣) يدعيه فهو بينهما نصفين.
It is narrated from Hazrat Harith that there was shared wealth between two persons. One of them claimed half of the wealth, and the other claimed two-thirds. He said: The one who claimed two-thirds will receive half of the wealth, because the one who claimed half is absolved from the other half, and the one who claimed half will be given one-third, because the one who claimed two-thirds is absolved from one-third, and the remaining one-sixth will be shared between the two.
