Hadith 22464
٢٢٤٦٤ - حدثنا أبو بكر قال: حدثنا حميد بن عبد الرحمن عن (حسن) (١) بن صاع عن أشعث عن الحكم في الرجل يكون في يده الثوب فيقيم الرجل البينة أنه ثوبه، ويقيم الذي (هو) (٢) في يده البينة أنه ثوبه، فقال: هو للذي في يده، وقال في الدابة: يقيم هذا البينة (أنها دابته) (٣)، ويقيم الذي (هي) (٤) في يده البينة أنها دابته قال: هي للذي في يده.
Hazrat Hakam states that a man had a piece of cloth. Another man presented witnesses that it was his cloth, and the one who had it also presented witnesses that it was his. So he said that it belongs to the one in whose possession it is. And regarding an animal, one man presented witnesses that it was his animal, and the one who had possession of it also presented witnesses that it was his animal. He said that it belongs to the one in whose possession it is.
