الرجل يكون بين الرجلين فيكاتب بعضهمA Slave Shared Between Two Men, and One Makes Him a Mukatab
Hadith 22377
٢٢٣٧٧ - حدثنا أبو بكر قال: حدثنا عبد اللَّه بن مبارك عن يعقوب بن القعقاع عن مطر عن الحسن في عبد بين ثلاثة؛ كاتبه أحدهم قال: يؤخذ منه ما أخذ منه فيقسم بين شركائه، والعبد بينهم [لا (تجوز) (١) كتابته.
Hasan (may Allah have mercy on him) said regarding a slave who is shared between three men, and then one of them makes him a mukatab (contracted for manumission): what that person receives from the mukatab slave will be taken from him and the wealth will be divided among the three partners, and the slave will remain the property of all three. It is not permissible to make him a mukatab.
