Hadith 22030
٢٢٠٣٠ - حدثنا أبو بكر قال: حدثنا ابن علية عن خالد الحذاء أن رجلا اشترى دارا (فبناها) (١) ثم جاء رجل فاستحقها، فكتب أن تقوم العرصة ويقوم البناء، فإن شاء أخذ البناء بقيمته، وإن أبى سلم العرصة بقيمتها.
Hazrat Khalid Hadhdha says that a man bought a house and constructed it, then another man turned out to be entitled to it. In such a case, the value of the land and the building should be assessed. If the entitled person wishes, he may pay the price of the building and take it, and if he refuses, then the land should be handed over to the buyer along with its price.
