٢١٩٥٤ - حدثنا أبو بكر قال: حدثنا غندر عن شعبة قال: سألت الحكم عن رجل قال لغلامه: نصفك حر، قال: إن كان كما (يقولون) (١) الضمان حق، فهو عتيق، وكان (من) (٢) رأي الحكم أن يعتقه،
Hazrat Sha’bah says that I asked Hazrat Hakam, if a person says to his slave, “Half of you is free,” what is the ruling? He replied that the predecessors used to say that guarantee is a right, so he will become free. Hazrat Hakam’s opinion was that he should set him free. The narrator says that I asked Hazrat Hammad about this matter, so he said that he should free half of him, and for the rest, he will strive.
