٢١٣٧٢ - حدثنا ابن علية عن ابن عون عن إبراهيم قال: إذا اشترى الرجل المتاع فقال المشتري: (انقله إليَّ) (١) وقال البائع: لا، حتى (تأتيني) (٢) بالثمن فهذا بمنزلة الرهن، (إن) (٣) هلك فهو من مال البائع، وإن قال: البائع للمشتري: انقله، فقال: دعه حتى (نأتيك) (٤) بالثمن، فهذا بمنزلة الوديعة، إن هلك فهو من مال المشتري، ويبيع هذا ولا يبيع ذاك.
Ibrahim says that if a man bought something and the buyer said, "Hand it over to me," and the seller said, "I will not give it to you until you bring the price," then this transaction will be considered as a pledge. If it is destroyed, it will be from the seller's property. And if the seller said to the buyer, "Take it into your possession," and the buyer said, "I will not take possession until I bring the price," then this will be under the ruling of a deposit. If it is destroyed, it will be destroyed from the buyer's property. Ibn Aun says that I mentioned this to Muhammad, and he said, "In my opinion, he spoke the truth."
