ما قالوا هه الرجل تهدي إليه امرأته فتقول: لم (يمسني) و (يصدقها)، ما لها من الصداق؟If a Man Is Presented with His Wife, but Both Say There Was No Consummation—Does She Receive a Dowry?
Hadith 18474
١٨٤٧٤ - حدثنا أبو بكر قال: حدثنا هشيم عن خالد عن (عزرة) (١) ⦗٢٨⦘ شريح أنه قال في رجل (أهديت) (٢) إليه امرأته فزعم أنه لم يدخل بها، وأقرت هي بذلك فقضى لها بنصف الصداق وألزمها العدة (و) (٣) قال (٤): أصدقكِ على نفسك، ولا أصدقك لنفسك.
Hazrat Shurayh (may Allah have mercy on him) says that if a man is presented with his wife, but he claims that he did not have intercourse with her, and the woman also admits this, then the woman will receive half the dowry and 'iddah will also be obligatory upon her. Furthermore, after making this decision, Qazi Shurayh (may Allah have mercy on him) said: I do not confirm your claim upon your own self, nor do I confirm the woman's claim upon her own self.
