Hadith 18438
١٨٤٣٨ - حدثنا يزيد (عن) (١) حبيب عن عمرو بن هرم عن جابر بن زيد سئل عن رجل كانت تحته نصرانية فأسلمت وأبى زوجها أن يسلم قال: أرى أن يفرق بينهما، فإن كان دخل بها فلها المهر كاملًا، وإن (لم يكن) (٢) (دخل بها) (٣) ردت إليه ما أعطاها.
Hazrat Jabir bin Zaid (may Allah have mercy on him) was asked: If a Christian woman is married to a non-believing man and the woman accepts Islam while her husband refuses to accept Islam, what is the ruling? Hazrat Jabir bin Zaid (may Allah have mercy on him) replied: In my opinion, separation will be established between them. If the man has consummated the marriage, the woman will receive the full dowry, and if consummation has not taken place, the woman will return the received wealth.
