Musannaf Ibn Abi Shaybah

Hazrat Sha’bi (may Allah have mercy on him) narrates that in Syria, some girls gathered to play. One girl climbed on top of another, and the one underneath was pressed down, causing her hymen to be ruptured. This case was brought before Abdul Malik bin Marwan, who asked Fadala bin Ubaid (may Allah have mercy on him) and Qabeesa bin Dhu’ayb (may Allah have mercy on him) about it. Both of them said that blood money (diyah) would be obligatory on all the girls, and one share would be lifted. Ibn Ma’qil (may Allah have mercy on him) said that the diyah should only be upon the one who pressed her down. Hazrat Sha’bi (may Allah have mercy on him) says that in my opinion, this is what should be done, and instead of diyah, compensation should be given for the rupture of the hymen.
