ما قالوا في (الرجل) يقع على مكاتبتهCan a Man Have Intercourse with a Mukatabah Slave Woman?
Hadith 18198
١٨١٩٨ - [حدثنا ابن مهدي (١) عن الدستوائي عن (قتادة) (٢) في رجل (وطيء) (٣) مكاتبته قال] (٤): إن كان استكرهها فعليه العقر (٥) والحد وإن كانت طاوعته فعليه الحد وليس عليه (العقر) (٦).
Hazrat Qatadah (may Allah have mercy on him) says that if a person has intercourse with his mukatabah slave woman, if he does so by force, then the hadd (punishment) will be applied and he will also have to pay 'aqr (compensation for the violated private part). And if he does so with the consent of the mukatabah, then the hadd will be applied but he will not have to pay 'aqr.
