Hadith 18130
١٨١٣٠ - حدثنا يزيد بن هارون عن حبيب عن (عمرو) (١) عن جابر بن زيد قال: سئل عمن تزوج امرأة ثم طلقها قبل أن يمسها ثم قيل له: إنها لم تحرم عليك فدخل بها (بالنكاح) (٢) الأول فمكثت عنده سنتين فولدت له أولادًا فعلم بذلك أنها عليه حرام قال: يفرق بينهما ويعطي المرأة بنكاحها الأول نصف مهرها، (ومن دخوله) (٣) بها ومجامعته إياها مهرًا كاملًا.
Hazrat Jabir bin Zaid (may Allah have mercy on him) was asked: If a man divorces his wife before touching her, and it is said to him that she has not become forbidden for you, and then he has intercourse with her on the basis of the first marriage, and the woman stays with the man for two years and gives birth to children, then they come to know that this woman had actually become forbidden for this man—what is the ruling? Hazrat Jabir bin Zaid (may Allah have mercy on him) replied: Separation will be established between the two; the man will give the woman half the dowry due to the first marriage, and the full dowry due to intercourse and consummation.
