Hadith 16683
١٦٦٨٣ - حدثنا معتمر عن أبيه قال: (قلت) (١) للحسن: جارية من أهل ⦗١٦٤⦘ الأرض (يعني) (٢) ليس لها مولى، خطبها رجل، (يزوجها) (٣) رجل من جيرانها، قال: (تأتي) (٤) الأمير قال: فإنها أضعف من ذلك، قال: فتكلم رجلًا (يكلم) (٥) لها الأمير، قال: فإنها أضعف من ذلك، قال: لا أعلم إلا (ذلك) (٦) قال: قلت له: (فالقاضي؟ قال) (٧): فالقاضي (إذن) (٨)، إلا أنه يجعل القاضي رخصة.
Hazrat Mu'tamir's father says that I asked Hasan: If a girl has no guardian and someone sends her a marriage proposal, can her neighbor arrange her marriage? Hasan replied that she should speak to the ruler of the time. I asked: What if she does not have access to him? He replied that she should appoint someone to speak to the ruler on her behalf. I asked: What if she does not have access to him either? He replied: I do not know more than this. I asked: Can a judge arrange her marriage? He replied: Yes, in that case the judge can arrange it. However, Hasan allowed this as a concession for the judge.
