The adulterer is not a believer while committing adultery.

Hadith 43
It is narrated from Sayyiduna Abu Hurairah, may Allah be pleased with him, that the Messenger of Allah, peace and blessings be upon him, said: The adulterer does not commit adultery while he is a believer at the time of committing adultery, and the thief does not steal while he is a believer at the time of stealing, and the one who drinks wine does not drink it while he is a believer at the time of drinking it. And Sayyiduna Abu Hurairah, may Allah be pleased with him, would add to this: Nor does the one who plunders, such a plunder that is a significant thing (i.e., not something insignificant) to which people raise their eyes, he too is not a believer at the time of plundering. And in the narration of Hammam, instead of (يَرْفَعُإِلَيْهِالْمُؤْمِنُونَأَعْيُنَهُمْ), the words are (وَهُوَحِينَيَنْتَهِبُهَامُؤْمِنٌ). And in another narration, it is mentioned that at the time of committing betrayal (also, a person) is not a believer.
