Mukhtasar Muslim

Sayyiduna Jabir (may Allah be pleased with him) reports that the Messenger of Allah (peace and blessings be upon him) decreed the right of pre-emption (shuf‘ah) in every joint property that is undivided, whether it is land or a garden. It is not permissible for one partner to sell his share without informing the other partner. Then the other partner has the choice: if he wishes, he may take it, and if he wishes, he may leave it. Now, if it is sold without informing (the partner), then that partner has more right (he can take it himself from the outsider for the same price).
