Hadith 890

Abu Ishaq says: I was sitting with Aswad bin Yazid in the great mosque, and Sha'bi was also with us. Sha'bi narrated the hadith of Sayyida Fatimah bint Qais (may Allah be pleased with her) that the Messenger of Allah (peace and blessings be upon him) neither provided her with a house nor maintenance. (Upon hearing this) Aswad picked up a handful of pebbles and threw them towards Sha'bi and said: Alas, do you narrate this? Whereas Sayyiduna Umar (may Allah be pleased with him) said: We cannot leave the Book of Allah and the Sunnah of our Noble Prophet (peace and blessings be upon him) for the statement of a woman; who knows, perhaps she forgot or remembered incorrectly. (A woman divorced with three pronouncements) should be given a house and maintenance, for Allah the Exalted has said: "Do not expel them from their houses unless they commit a clear indecency (i.e., adultery)." (At-Talaq: 1)
