Hadith 1082
Umm al-Mu'mineen Aisha Siddiqa (may Allah be pleased with her) narrates from the Noble Prophet (peace and blessings be upon him) that he (peace be upon him) said: "Whoever cultivates a land that does not belong to anyone, then the one who cultivates it has the greatest right to it."

Hadith 1083
Narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that Sayyiduna Umar bin Khattab (may Allah be pleased with him) expelled the Jews and Christians from the land of Hijaz, and when the Messenger of Allah (peace and blessings of Allah be upon him) gained dominance over Khaybar, he intended to expel the Jews from there. And at the time when the Messenger of Allah (peace and blessings of Allah be upon him) gained dominance over Khaybar, the land there became the property of Allah, His Messenger (peace and blessings of Allah be upon him), and all Muslims. So when the Messenger of Allah (peace and blessings of Allah be upon him) intended to expel the Jews from there, the Jews requested the Messenger of Allah (peace and blessings of Allah be upon him) to let them stay there on the condition that they would work there and receive half of the fruits. Then the Messenger of Allah (peace and blessings of Allah be upon him) said to them: "Alright! We will keep you as long as we wish." Thus, they stayed there until Sayyiduna Umar (may Allah be pleased with him) expelled them towards (the places of) Tayma and Ariha.
