Narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that his father (the Commander of the Faithful, Umar bin Khattab, may Allah be pleased with him) donated a property (a garden) named Thamgh in the time of the Messenger of Allah (peace and blessings of Allah be upon him). So Sayyiduna Umar (may Allah be pleased with him) submitted: "O Messenger of Allah! I have acquired a property and it is very precious to me. I wish to give it in charity." The Noble Prophet (peace and blessings of Allah be upon him) said: "Give away the original trees as charity on the condition that they are neither sold, nor gifted, nor inherited, but its fruits are spent in the way of Allah." Thus, Sayyiduna Umar (may Allah be pleased with him) gave it in charity on this condition, so that its income would be spent on warriors in the cause of Allah, freeing slaves, the needy, guests, travelers, and relatives. (And he also said that) whoever is its caretaker, there is no sin upon him if he eats from it according to custom or feeds his friend, provided that he does not intend to accumulate wealth by this act.
