Hadith 1186
حَدَّثَنَا
الْحَسَنُ بْنُ عَلِيِّ بْنِ خَلَفٍ الدِّمَشْقِيُّ ، حَدَّثَنَا
سُلَيْمَانُ بْنُ عَبْدِ الرَّحْمَنِ ابْنِ بِنْتِ شُرَحْبِيلَ ، حَدَّثَنَا
مُحَمَّدُ بْنُ عَبْدِ اللَّهِ الذِّمَارِيُّ ، عَنْ
زَيْدِ بْنِ أَبِي أُنَيْسَةَ ، عَنْ
أَبِي الزُّبَيْرِ ، عَنْ
جَابِرٍ ، قَالَ : " رُفِعَ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ
رَجُلٌ طَعَنَ رَجُلا عَلَى فَخِذِهِ بِقَرْنٍ ، فَقَالَ الَّذِي طُعِنَتْ فَخِذُهُ : أَقِدْنِي يَا رَسُولَ اللَّهِ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ : دَاوِهَا وَاسْتَأِنْ بِهَا حَتَّى نَنْظُرَ إِلَى مَا تَصِيرُ ، فَقَالَ الرَّجُلُ يَا رَسُولَ اللَّهِ أَقِدْنِي ، فَقَالَ لَهُ مثل ذَلِكَ ، فَقَالَ الرَّجُلُ : أَقِدْنِي يَا رَسُولَ اللَّهِ ، فَأَقَادَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ ، فَيَبِسَتْ رَجِلُ الرَّجُلِ الَّذِي أَقَادَهُ ، اسْتَقَادَهُ ، وَبَرِئَ رِجْلُ الرَّجُلِ الَّذِي اسْتُقِيدَ مِنْهُ ، فَأَبْطَلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ دِيَتَهَا "، لَمْ يَرْوِهِ عَنْ زَيْدٍ ، إِلا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ ، تَفَرَّدَ بِهِ سُلَيْمَانُ
Sayyiduna Jabir (may Allah be pleased with him) narrates: A case was brought before the Prophet (peace and blessings be upon him) regarding a man who had struck someone on his thigh with a horn, injuring his thigh. He said: O Messenger of Allah! Grant me retribution (qisas). The Prophet (peace and blessings be upon him) said: “Treat the wound, and wait for a while until we see what happens to the injury.” He said: O Messenger of Allah! Grant me retribution. The Prophet (peace and blessings be upon him) again told him the same thing, but the man insisted: O Messenger of Allah! Grant me retribution. So the Prophet (peace and blessings be upon him) allowed him to take retribution. As a result, his (the claimant’s) leg swelled up, while the leg of the one from whom retribution was taken became fine. So the Prophet (peace and blessings be upon him) invalidated his compensation (diyah).
