Inheritance of granddaughter and real sister in the presence of a daughter
Hadith 1150
حَدَّثَنَا عَلِيُّ بْنُ عِيسَى الْكَاتِبُ الْوَزِيرُ ، مُذَاكَرَةً ، حَدَّثَنَا الْحَسَنُ بْنُ مُحَمَّدٍ الزَّعْفَرَانِيُّ ، حَدَّثَنَا إِسْحَاقُ بْنُ يُوسُفَ الأَزْرَقُ ، حَدَّثَنَا مِسْعَرُ بْنُ كِدَامٍ ، عَنْ أَبِي قَيْسٍ الأَوْدِيِّ عَبْدِ الرَّحْمَنِ بْنِ ثَرْوَانَ عَنْ هُذَيْلِ بْنِ شُرَحْبِيلَ ، عَنْ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ رَضِيَ اللَّهُ عَنْهُ ، أَنَّهُ أُتِيَ فِي ابْنَةٍ ، وَابْنَةِ أُخْتٍ ، وَأُخْتٍ لأَبٍ وَأُمٍّ ، فَقَالَ : "لأَقْضِيَنَّ بَيْنَهُمْ بِقَضَاءِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ : لِلابْنَةِ النِّصْفُ ، وَلابْنَةِ الابْنِ السُّدُسُ ، وَمَا بَقِيَ فَلِلأُخْتِ مِنَ الأَبِ وَالأُمِّ "، لَمْ يَرْوِهِ عَنْ مِسْعَرٍ ، إِلا إِسْحَاقُ ، تَفَرَّدَ بِهِ الزَّعْفَرَانِيُّ
This legal question was brought to Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him): A deceased woman leaves behind a daughter, a granddaughter, and a full sister. He said: I will decide among them as the Prophet (peace and blessings of Allah be upon him) decided. The daughter will receive half, the granddaughter will receive one-sixth, and whatever remains will go to the sister.
