Hadith 537

حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ أَحْمَدَ بْنِ الْفَرَجِ الْبَغْدَادِيُّ ، حَدَّثَنَا الْفُضَيْلُ بْنُ الْحُسَيْنِ أَبُو كَامِلٍ الْجَحْدَرِيُّ ، حَدَّثَنَا عُثْمَانُ بْنُ عَبْدِ الرَّحْمَنِ الْجُمَحِيُّ ، حَدَّثَنَا أَيُّوبُ السِّخْتِيَانِيُّ ، عَنْ عَمْرِو بْنِ دِينَارٍ ، عَنْ طَاوُسٍ ، عَنْ حُجْرٍ الْمَدَرِيِّ ، عَنْ زَيْدِ بْنِ ثَابِتٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ ، "الْعُمْرَى لِلْوَارِثِ "، لَمْ يَرْوِهِ عَنْ أَيُّوبَ ، إِلا عُثْمَانُ ، تَفَرَّدَ بِهِ أَبُو كَامِلٍ
Sayyiduna Zayd bin Thabit (may Allah be pleased with him) narrates from the Noble Prophet (peace and blessings be upon him) that the rightful claimant of ‘Umra is the heir.

Benefits and Issues:
Whatever is given to someone for a lifetime will not return to the giver after the recipient’s death; rather, just as the rest of the deceased’s estate is distributed among his heirs, so too will the thing received in this manner be included in the inheritance and divided among his heirs. This is because, according to the Shariah, this item falls under the ruling of a gift (hiba), and therefore it will be considered the lawful property of the recipient.
