Mishkat al-Masabih
كتاب العتقThe Book of Emancipation
(الْعَبْدُ يَصْبَحُ مَالِكًا لِمَالِهِ بَعْدَ التَّحْرِيرِ بِإِذْنِ سَيِّدِهِ)
(A slave becomes the owner of his wealth after emancipation with his master’s permission)
Hadith 3396
وَعَنِ ابْنِ عُمَرَ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «مَنْ أَعْتَقَ عَبْدًا وَلَهُ مَالٌ فَمَالُ الْعَبْدِ لَهُ إِلَّا أَنْ يَشْتَرِطَ السَّيِّدُ» . رَوَاهُ أَبُو دَاوُدَ وَابْنُ مَاجَهْ
Ibn ‘Umar reported God’s Messenger as saying, “If anyone emancipates a slave who owns property he gets the slave’s property, unless the master stipulates otherwise.” Abu Dawud and Ibn Majah transmitted it.
