The Book of Retaliation
(بَيَانُ دِيَةِ القَتْلِ العَمْدِ وَالقَتْلِ شِبْهِ العَمْدِ)
(Statement on the blood money for intentional killing and quasi-intentional killing)
Hadith 3501
وَعَنْهُ عَنْ أَبِيهِ عَنْ جَدِّهِ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «عَقْلُ شِبْهِ الْعَمْدِ مُغَلَّظٌ مِثْلُ عَقْلِ الْعَمْدِ وَلَا يُقْتَلُ صاحبُه» . رَوَاهُ أَبُو دَاوُد
He said, on his father’s authority, that his grandfather reported the Prophet as saying, “Blood wit for what resembles intentional murder is to be made as severe as that for intentional murder, but the Culprit is not to be killed.” Abu Dawud transmitted it.
