Hadith 112

‏‏‏‏وَعَنِ ابْنِ مَسْعُودٍ رَضِيَ اللَّهُ عَنْهُ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: الوائدة والموؤدة فِي النَّار ". رَوَاهُ أَبُو دَاوُد
Ibn Mas'ud reported God’s messenger as saying, “The one who buries her daughter alive and the one who is buried alive go to hell.” Abu Dawud transmitted it.

Hadith Authentication:
The chain of narration for this report is absolutely authentic.
● Zakariya ibn Abi Za'idah has explicitly stated hearing (sama'), and his narration from Abu Ishaq Amr ibn al-Sabi'i is found in Sahih al-Bukhari and Sahih Muslim; therefore, the allegation of confusion (ikhtilat) in this narration is incorrect.

Jurisprudential Explanation of the Hadith:
➊ The ruling for the children of disbelievers (kuffar) is the same as that of their parents.
➋ If a disbeliever is killed unjustly, this by no means implies that he will enter Paradise.
➌ Some scholars have written that this is a specific incident concerning a particular individual. «والله اعلم»

➎ This narration is not found in Sunan al-Tirmidhi, and in some manuscripts of Mishkat, only «رواه أبوداود» is written, and this is the preferred view.

Benefits and Issues:
One who was unjustly buried alive in childhood cannot be deserving of Hellfire.
Ibn Abbas radi Allahu anhu has clearly stated that the belief regarding the maw’udah (the girl buried alive) being from the people of Hell is not correct.
He said: According to the verse (We do not punish until We send a Messenger) (: Bani Isra’il: 15), if an intelligent and mature person who has not received the message cannot be punished, then how can a non-intelligent (child) be punished?
It has already been clarified that even the children of the polytheists will not be punished.
Hadith 14717 is part of a lengthy hadith.
It is a portion of the original hadith.
In the original hadith, there is detail that Salamah bin Buzayd al-Ju‘fi and his brother came to the service of the Messenger sallallahu alayhi wa sallam and said: Our mother Malikah (who died in the time of ignorance) was a good woman, one who maintained family ties and honored guests. Will these qualities benefit our mother? He sallallahu alayhi wa sallam replied: No. They asked: Our mother had buried one of our sisters alive; will this benefit her in any way? He sallallahu alayhi wa sallam replied: (Both) the one who buried alive and the one who was buried alive are in the Fire.
Thus, your answer was regarding a specific maw’udah.
This was not a general ruling; most likely, this maw’udah had reached maturity while still in a state of disbelief.
