بَابُ : الْوَلَدِ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ
Chapter: The child is for the bed and the fornicator gets nothing
Hadith 2004
حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ ، عَنْ الزُّهْرِيِّ ، عَنْ عُرْوَةَ ، عَنْ عَائِشَةَ ، قَالَتْ : إِنَّ عَبْدَ بْنَ زَمْعَةَ وَسَعْدًا اخْتَصَمَا إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي ابْنِ أَمَةِ زَمْعَةَ ، فَقَالَ سَعْدٌ : يَا رَسُولَ اللَّهِ ، أَوْصَانِي أَخِي إِذَا قَدِمْتُ مَكَّةَ أَنْ أَنْظُرَ إِلَى ابْنِ أَمَةِ زَمْعَةَ فَأَقْبِضَهُ ، وَقَالَ عَبْدُ بْنُ زَمْعَةَ : أَخِي وَابْنُ أَمَةِ أَبِي وُلِدَ عَلَى فِرَاشِ أَبِي ، فَرَأَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ شَبَهَهُ بِعُتْبَةَ ، فَقَالَ : " هُوَ لَكَ يَا عَبْدَ بْنَ زَمْعَةَ الْوَلَدُ لِلْفِرَاشِ ، وَاحْتَجِبِي عَنْهُ يَا سَوْدَةُ " .
´It was narrated that 'Aishah said:` Ibn Zam'ah and Sa'd (Ibn Abu Waqqas) referred a dispute to the Prophet concerning the son of Zam'ah's slave woman. Sa'd said : " O Messenger of Allah my brother (Utbah bin Abu Waqqas) left instructions in his will that when I come to Makkah, I should look for the son of the slave woman of Zam'ah and take him into my care." 'Abd bin Zam’ah said: "He is my brother and the son of the slave woman of my father; he was born on my father's bed." The Prophet ffi saw that he resembled 'Utbah, and said: "He belongs to you, O 'Abd bin Zam'ah. The child is for the bed. Observe Hijab before him, O Saudah." (sahih)
Hadith 2005
حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ ، عَنْ عُبَيْدِ اللَّهِ بْنِ أَبِي يَزِيدَ ، عَنْ أَبِيهِ ، عَنْ عُمَرَ ، " أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى بِالْوَلَدِ لِلْفِرَاشِ " .
´It was narrated from 'Umar that:` the Messenger of Allah ruled that the child belonged to the bed.
Hadith 2006
حَدَّثَنَا هِشَامُ بْنُ عَمَّارٍ ، قَالَ : حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ ، عَنْ الزُّهْرِيِّ ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ ، عَنْ أَبِي هُرَيْرَةَ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ " .
´It was narrated from Abu Hurairah that:` the Prophet said: "The child is for the bed (i.e., belongs to the husband) and the fornicator gets nothing!'
Hadith 2007
حَدَّثَنَا هِشَامُ بْنُ عَمَّارٍ ، قَالَ : حَدَّثَنَا إِسْمَاعِيل بْنُ عَيَّاشٍ ، حَدَّثَنَا شُرَحْبِيلُ بْنُ مُسْلِمٍ ، قَالَ : سَمِعْتُ أَبَا أُمَامَةَ الْبَاهِلِيَّ ، يَقُولُ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ : " الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ " .
´Shurahbil bin Muslim said:` "I heard Abu Um Amah Al-Bahili say: 'I heard the Messenger of Allah say: "The child is for the bed and the fornicator gets nothing."
