بَابُ : لاَ نِكَاحَ إِلاَّ بِوَلِيٍّ
Chapter: No marriage except with a guardian
Hadith 1879
حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، حَدَّثَنَا مُعَاذُ بْنُ مُعَاذٍ ، حَدَّثَنَا ابْنُ جُرَيْجٍ ، عَنْ سُلَيْمَانَ بْنِ مُوسَى ، عَنِ الزُّهْرِيِّ ، عَنْ عُرْوَةَ ، عَنْ عَائِشَةَ ، قَالَتْ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَيُّمَا امْرَأَةٍ لَمْ يُنْكِحْهَا الْوَلِيُّ فَنِكَاحُهَا بَاطِلٌ ، فَنِكَاحُهَا بَاطِلٌ ، فَنِكَاحُهَا بَاطِلٌ ، فَإِنْ أَصَابَهَا فَلَهَا مَهْرُهَا بِمَا أَصَابَ مِنْهَا ، فَإِنِ اشْتَجَرُوا فَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ " .
´It was narrated from Aishah that :` the Messenger of Allah said: “Any woman whose marriage is not arranged by her guardian, her marriage is invalid, her marriage is invalid, her marriage is invalid. If (the man) has had intercourse with her, then the Mahr belongs to her in return for his intimacy with her. And if there is any dispute then the ruler is the guardian of the one who does not have a guardian.”
Hadith 1880
حَدَّثَنَا أَبُو كُرَيْبٍ ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ الْمُبَارَكِ ، عَنْ حَجَّاجٍ ، عَنِ الزُّهْرِيِّ ، عَنْ عُرْوَةَ ، عَنْ عَائِشَةَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وعَنْ عِكْرِمَةَ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَا : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لَا نِكَاحَ إِلَّا بِوَلِيٍّ " ، وَفِي حَدِيثِ عَائِشَةَ : " وَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ " .
´It was narrated that:` Aisha and Ibn Abbas said: “The Messenger of Allah said: 'There is no marriage except with a guardian.' ”According to the Hadith of Aishah: “And the ruler is the guardian of the one who does not have a guardian. ”
Hadith 1881
حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ الْمَلِكِ بْنِ أَبِي الشَّوَارِبِ ، حَدَّثَنَا أَبُو عَوَانَةَ ، حَدَّثَنَا أَبُو إِسْحَاق الْهَمْدَانِيُّ ، عَنْ أَبِي بُرْدَةَ ، عَنْ أَبِي مُوسَى ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لَا نِكَاحَ إِلَّا بِوَلِيٍّ " .
´It was narrated from Abu Musa that:` the Messenger of Allah said: “There is no marriage except with a guardian.”
Hadith 1882
حَدَّثَنَا جَمِيلُ بْنُ الْحَسَنِ الْعَتَكِيُّ ، حَدَّثَنَا مُحَمَّدُ بْنُ مَرْوَانَ الْعُقَيْلِيُّ ، حَدَّثَنَا هِشَامُ بْنُ حَسَّانَ ، عَنْ مُحَمَّدِ بْنِ سِيرِينَ ، عَنْ أَبِي هُرَيْرَةَ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لَا تُزَوِّجُ الْمَرْأَةُ الْمَرْأَةَ ، وَلَا تُزَوِّجُ الْمَرْأَةُ نَفْسَهَا ، فَإِنَّ الزَّانِيَةَ هِيَ الَّتِي تُزَوِّجُ نَفْسَهَا " .
´It was narrated from Abu Hurairah that:` the Messenger of Allah said: “No woman should arrange the marriage of another woman, and no woman should arrange her own marriage. The adulteress is the one who arranges her own marriage.”
