بَابُ : الرُّخْصَةِ فِي ذَلِكَ فِي الْكُنُفِ وَإِبَاحَتِهِ دُونَ الصَّحَارَى
Chapter: Permission concerning that in the toilet with walls and its permissiblity, not in deserts
Hadith 322
حَدَّثَنَا هِشَامُ بْنُ عَمَّارٍ ، حَدَّثَنَا عَبْدُ الْحَمِيدِ بْنُ حَبِيبٍ ، حَدَّثَنَا الْأَوْزَاعِيُّ ، حَدَّثَنِي يَحْيَى بْنُ سَعِيدٍ الْأَنْصَارِيُّ . ح وحَدَّثَنَا أَبُو بَكْرِ بْنُ خَلَّادٍ ، وَمُحَمَّدُ بْنُ يَحْيَى ، قَالَا : حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ ، أَنْبَأَنَا يَحْيَى بْنُ سَعِيدٍ ، أَنَّ مُحَمَّدَ بْنَ يَحْيَى بْنِ حَبَّانَ ، أَخْبَرَهُ أَنَّ عَمَّهُ وَاسِعَ بْنَ حَبَّانَ ، أَخْبَرَهُ أَنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ ، قَالَ : " يَقُولُ أُنَاسٌ : إِذَا قَعَدْتَ لِلْغَائِطِ فَلَا تَسْتَقْبِلِ الْقِبْلَةَ ، وَلَقَدْ ظَهَرْتُ ذَاتَ يَوْمٍ مِنَ الْأَيَّامِ عَلَى ظَهْرِ بَيْتِنَا ، " فَرَأَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَاعِدًا عَلَى لَبِنَتَيْنِ مُسْتَقْبِلَ بَيْتِ الْمَقْدِسِ " هَذَا حَدِيثُ يَزِيدَ بْنِ هَارُونَ .
´'Abdullah bin 'Umar said:` "People say: 'When you sit to relieve yourself, do not face the Qiblah.' But one day I climbed up onto the roof of our house, and I saw the Messenger of Allah sitting on two bricks (to relieve himself), facing the direction of Baitul-Maqdis (Jerusalem)." This is a Hadith narrated by Yazid bin Harun.
Hadith 323
حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى ، حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ مُوسَى ، عَنْ عِيسَى الْحَنَّاطِ ، عَنْ نَافِعٍ ، عَنْ ابْنِ عُمَرَ ، قَالَ : رَأَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " فِي كَنِيفِهِ مُسْتَقْبِلَ الْقِبْلَةِ " ، قَالَ عِيسَى : فَقُلْتُ ذَلِكَ لِلشَّعْبِيِّ ، فَقَالَ : صَدَقَ ابْنُ عُمَرَ ، وَصَدَقَ أَبُو هُرَيْرَةَ ، أَمَّا قَوْلُ أَبِي هُرَيْرَةَ ، فَقَالَ : " فِي الصَّحْرَاءِ لَا يَسْتَقْبِلِ الْقِبْلَةَ وَلَا يَسْتَدْبِرْهَا " ، وَأَمَّا قَوْلُ ابْنِ عُمَرَ : فَإِنَّ الْكَنِيفَ لَيْسَ فِيهِ قِبْلَةٌ ، اسْتَقْبِلْ فِيهِ حَيْثُ شِئْتَ .
´It was narrated that Ibn 'Umar said:` "I saw the Messenger of Allah in his (constructed) toilet, facing towards the Qiblah." (Da'if) (One of the narrators) 'Eisa said: "I told that to Sha'bi, and he said: 'Ibn 'Umar spoke the truth. As for the words of Abu Hurairah, he said: "In the desert do not face the Qiblah nor turn one's back towards it." As for the words of Ibn 'Umar, he said: "In the (constructed) toilet there is no Qiblah so turn in whatever direction you want." Another chain with similar wording.
Hadith 323M
قَالَ أَبُو الْحَسَنِ بْنُ سَلَمَةَ : وَحَدَّثَنَا أَبُو حَاتِمٍ ، حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ مُوسَى ، فَذَكَرَ نَحْوَهُ .
‘With this chain also,’ Ubaidullah bin Musa narrates in the same manner.
Hadith 324
حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، وَعَلِيُّ بْنُ مُحَمَّدٍ ، قَالَا : حَدَّثَنَا وَكِيعٌ ، عَنْ حَمَّادِ بْنِ سَلَمَةَ ، عَنْ خَالِدٍ الْحَذَّاءِ ، عَنْ خَالِدِ بْنِ أَبِي الصَّلْتِ ، عَنْ عِرَاكِ بْنِ مَالِكٍ ، عَنْ عَائِشَةَ ، قَالَتْ : ذُكِرَ عِنْدَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَوْمٌ يَكْرَهُونَ أَنْ يَسْتَقْبِلُوا بِفُرُوجِهِمُ الْقِبْلَةَ ، فَقَالَ : " أُرَاهُمْ قَدْ فَعَلُوهَا اسْتَقْبِلُوا بِمَقْعَدَتِي الْقِبْلَةَ " .
´It was narrated that 'Aishah said:` "Mention was made in the presence of the Messenger of Allah of some people who did not like to face towards the Qiblah with their private parts. He said: 'I think that they do that. Turn my seat (in the toilet) to face the Qiblah.'" (Da'if) Another chain with similar wording.
Hadith 324M
قَالَ أَبُو الْحَسَنِ الْقَطَّانُ : حَدَّثَنَا يَحْيَى بْنُ عُبَيْدٍ ، حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ الْمُغِيرَةِ ، عَنْ خَالِدٍ الْحَذَّاءِ ، عَنْ خَالِدِ بْنِ أَبِي الصَّلْتِ ، مِثْلَهُ .
With this chain also, it is narrated from Khalid bin Abi As-Salt in a similar manner.
Hadith 325
حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ ، حَدَّثَنَا وَهْبُ بْنُ جَرِيرٍ ، حَدَّثَنَا أَبِي ، قَالَ : سَمِعْتُ مُحَمَّدَ بْنَ إِسْحَاق ، عَنْ أَبَانَ بْنِ صَالِحٍ ، عَنْ مُجَاهِدٍ ، عَنْ جَابِرٍ ، قَالَ : " نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ نَسْتَقْبِلَ الْقِبْلَةَ بِبَوْلٍ " ، فَرَأَيْتُهُ قَبْلَ أَنْ يُقْبَضَ بِعَامٍ يَسْتَقْبِلُهَا .
´It was narrated that Jabir said:` "The Messenger of Allah forbade facing the Qiblah when urinating. But I saw him, one year before he died, facing the Qiblah (while urinating)."
