Hadith 374

حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى ، حَدَّثَنَا الْمُعَلَّى بْنُ أَسَدٍ ، حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ الْمُخْتَارِ ، حَدَّثَنَا عَاصِمٌ الْأَحْوَلُ ، عَنْ عَبْدِ اللَّهِ بْنِ سَرْجِسَ ، قَالَ : " نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يَغْتَسِلَ الرَّجُلُ بِفَضْلِ وَضُوءِ الْمَرْأَةِ ، وَالْمَرْأَةُ بِفَضْلِ الرَّجُلِ ، وَلَكِنْ يَشْرَعَانِ جَمِيعًا " .
´It was narrated that `Abdullah bin Sarjis said:` "The Messenger of Allah forbade men to perform ablution with the water left over by a woman, and women to perform ablution with water left over by a man, however both (spouses) may start to perform their ablutions at the same time." Abu `Abdullah Ibn Majah said: "The first (narration) is correct, and the second (narration) is Wahm (an error)." Another chain with similar wording.

Commentary:

Imam Ibn Majah rahimahullah said:
The first narration is authentic, and the second is an error.
This could mean that the first narration is authentic and in the second, the narrator made a mistake.
And it could also mean what was mentioned in the previous chapter: that husband and wife may perform ritual bath (ghusl) from the water left over by each other—that is correct.
And the issue in the second chapter, that is, its prohibition, is not the preferred view.

Some scholars have written regarding this prohibition that it is either from before the concession was granted, or it is based on precaution.
And the more correct view is what was mentioned in the previous chapter: that a woman and a man may perform ablution (wudu) from the water used and left over by each other.
