Hadith 3109

حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ نُمَيْرٍ ، حَدَّثَنَا يُونُسُ بْنُ بُكَيْرٍ ، حَدَّثَنَا مُحَمَّدُ بْنُ إِسْحَاق ، حَدَّثَنَا أَبَانُ بْنُ صَالِحٍ ، عَنْ الْحَسَنِ بْنِ مُسْلِمِ بْنِ يَنَّاقٍ ، عَنْ صَفِيَّةَ بِنْتِ شَيْبَةَ ، قَالَتْ : سَمِعْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَخْطُبُ عَامَ الْفَتْحِ ، فَقَالَ : " يَا أَيُّهَا النَّاسُ إِنَّ اللَّهَ حَرَّمَ مَكَّةَ يَوْمَ خَلَقَ السَّمَوَاتِ وَالْأَرْضَ ، فَهِيَ حَرَامٌ إِلَى يَوْمِ الْقِيَامَةِ ، لَا يُعْضَدُ شَجَرُهَا وَلَا يُنَفَّرُ صَيْدُهَا وَلَا يَأْخُذُ لُقْطَتَهَا إِلَّا مُنْشِدٌ " ، فَقَالَ الْعَبَّاسُ : إِلَّا الْإِذْخِرَ ، فَإِنَّهُ لِلْبُيُوتِ وَالْقُبُورِ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِلَّا الْإِذْخِرَ " .
´It was narrated that Safiyyah bint Shaibah said:` “I heard the Prophet (ﷺ) delivering a sermon in the Year of the Conquest (of Makkah), and he said: ‘O people, Allah made Makkah sacred the day He created the heavens and the earth, and it is sacred until the Day of Resurrection. Its trees are not to be cut, its game is not to be disturbed, and its lost property is not to be taken except by one who will announce it.’‘Abbas said: ‘Except for Idhkhir (a kind of fragrant grass), for it is (used) for houses and graves.’ The messenger of Allah (ﷺ) said: ‘Except for Idhkhir.’”

Benefits and Issues:
➊ Makkah has always been a sanctuary (haram) and will remain a sanctuary.
Prophet Ibrahim (alayhis salam) proclaimed its sanctity.

➋ There are some rulings that have remained constant in all divine laws.
Among these is the pilgrimage (hajj) to the noble Ka'bah and the sanctity of the Haram of Makkah.

➌ It is prohibited to cut trees within the Haram of Makkah.

➍ Hunting within the boundaries of the Haram is prohibited.

➎ If an animal enters the boundary of the Haram, it is not permissible for the hunter to attempt to drive it out of the sanctuary.

➏ Idhkhir is a special type of grass that grows abundantly in this region.

➐ It is permissible to cut idhkhir grass even within the boundaries of the Haram.

➑ Permission for idhkhir was sought from the Messenger of Allah (sallallahu alayhi wa sallam), and he granted it. This does not mean that the Noble Messenger (sallallahu alayhi wa sallam) has the right to amend the divine rulings; rather, this exception was also through revelation, because the statement of Allah, the Exalted, is:
(وَمَا يَنطِقُ عَنِ الْهَوَىٰ ‎﴿3﴾‏ إِنْ هُوَ إِلَّا وَحْيٌ يُوحَىٰ ‎)
() (an-Najm: 3, 4)
“The Prophet does not speak from his own desire; it is nothing but revelation that is sent down to him.”
