Hadith 3077

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ ، وَابْنُ عُلَيَّةَ ، عَنْ حَجَّاجِ بْنِ أَبِي عُثْمَانَ ، حَدَّثَنِي يَحْيَى بْنُ أَبِي كَثِيرٍ ، حَدَّثَنِي عِكْرِمَةُ ، حَدَّثَنِي الْحَجَّاجُ بْنُ عَمْرٍو الْأَنْصَارِيُّ ، قَالَ : سَمِعْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ : " مَنْ كُسِرَ أَوْ عَرَجَ فَقَدْ حَلَّ ، وَعَلَيْهِ حَجَّةٌ أُخْرَى " ، فَحَدَّثْتُ بِهِ ابْنَ عَبَّاسٍ ، وَأَبَا هُرَيْرَةَ ، فَقَالَا : صَدَقَ .
´It was narrated from ‘Ikrimah:` “Hajjaj bin ‘Amr Ansari narrated to me, he said: ‘I heard the Prophet (ﷺ) say: “Whoever breaks a bone or becomes lame, has exited Ihram, but he must perform another Hajj.”

This hadith is evidence that "ihsar" (prevention from completing pilgrimage) is valid not only due to an enemy but also because of illness or similar reasons, as is the position of the majority of scholars. Similarly, if a person, at the time of entering into ihram, stipulates a condition that wherever I am rendered incapable, I will become lawful (i.e., exit ihram), then upon being rendered incapable, he may exit ihram without any expiation. However, in the case of ihsar, it is necessary to slaughter an animal.

Urdu marginal note:
"Next year Hajj will be performed"—that is, if this was the obligatory Hajj (fard Hajj) and he still possesses the ability to reach the House of Allah (Baytullah). Otherwise, Hajj is not obligatory upon him. The same ruling applies to ‘Umrah.

1: In one narration of Abu Dawud, there is the addition of "min qābil" (from the coming year),
meaning that in the following year, he will make up for this pilgrimage (Hajj).
Khatabi says:
This is for the person for whom this Hajj was obligatory (fard Hajj).
However, if someone performing a voluntary (nafl) Hajj is prevented, then making it up (qada) is not required for him.
This is also the opinion of Malik and Shafi'i.
Whereas Imam Abu Hanifah and his companions say that both Hajj and 'Umrah become obligatory upon him.
This is also the opinion of Imam Nakha'i.

Benefits and Issues:


After entering into the state of ihram, if a person performing Hajj or Umrah faces an obstacle on the way, he is called a "muhsar" (one who is prevented).


When such a person becomes certain that it is impossible to continue the journey, he should remove his ihram right there.
If he has a sacrificial animal with him, he should slaughter it at that place.
This is what the Messenger of Allah (sallallahu alayhi wa sallam) and the noble Companions (radi Allahu anhum) did during the journey of the Treaty of Hudaybiyyah.


A Hajj that remains incomplete due to an excuse does not have the ruling of a complete Hajj; therefore, if one later has the ability to perform Hajj, it will be obligatory to do so.
