´It was narrated that ‘Aishah said:` “We said: ‘O Messenger of Allah, should we not build you a house in Mina that will be a means of shade for you?’ He said: ‘No, Mina is just a stopping place for those who get there first.’”

1؎: That is, the plain of Mina is endowed (waqf) for the pilgrims; it is not the private property of anyone. If someone arrives there first and settles in a particular spot, then another person cannot remove him from it. Since building a house would establish one’s possession and exclusive right over a place, the Prophet (sallallahu alayhi wa sallam) therefore forbade this.
´Aishah said:` "We said: 'O Messenger of Allah! Shall we build a structure to shade you at Mina? He said: 'No., Mina is a resting place for whoever arrives.'"

Commentary: 1: Because it is not permissible to allocate Mina exclusively for anyone, it is the land designated for acts of worship such as stoning (rami), sacrifice (dhabh), and shaving (halq), etc. If permission were given to build houses there, the entire plain would become filled with buildings, and there would be no space left for worship.
