´It was narrated that ‘Abdullah bin ‘Amr said:` “There was a man called Kirkah in charge of the goods of the Prophet (ﷺ), who died. The Prophet (ﷺ) said: ‘He is in Hell.’ They went and looked, and found him wearing a garment or a cloak that he had stolen from the spoils of war.”

Benefits and Issues:

Committing treachery with war booty (mal-e-ghanima) is a very grave crime.
➋
Even if the stolen item is insignificant, it does not lessen the severity of the crime.
➌
This hadith also refutes those who claim that a believer (mu’min) cannot enter Hell.
Upon reflecting on the evidences from the Book and the Sunnah, it becomes clear that due to a major sin, a sinful believer can also become deserving of Hell. However, the eternal punishment of Hell is only for disbelievers (kuffar) and polytheists (mushrikun).
And Allah knows best.

Hadith Commentary:
It is understood from this that even the theft of a very small thing from war booty (mal-e-ghaneemat) is forbidden (haram), and its punishment is certainly Hell.
This hadith refutes those who claim that a believer will not enter Hell due to sins.
The Noble Qur’an has clearly declared:
﴿وَمَنْ یَّغْلُلْ یَاْتِ بِمَا غَلَّ یَوْمَ الْقِیٰمَةِ﴾ (Aal Imran: 161)
Whoever commits treachery will come on the Day of Resurrection carrying what he betrayed.
This is such a crime that even if it is committed by a mujahid, his act of jihad becomes invalidated, as is evident from this hadith.
And in the hadith is the prohibition of both little and much of ghulul (embezzlement from war booty), and his statement “he is in the Fire” means he will be punished for the sin, or the meaning is: he is in the Fire if Allah does not pardon him.

Hadith Commentary:

Some people are of the opinion that the belongings and possessions of the one who steals from the spoils of war (mal-e-ghanīmat) should be burned, as is mentioned in a narration of Abu Dawud rahimahullah.
(Sunan Abi Dawud, al-Jihad, Hadith: 2713)
However, the position of Imam Bukhari rahimahullah is that in the narration which Abdullah bin Amr radi Allahu anhu has transmitted from the Messenger of Allah sallallahu alayhi wa sallam regarding this matter, there is no mention of burning the belongings.
On this basis, the correct view is that it is not permissible to burn the belongings of the one who commits treachery; rather, according to this narration, the one who steals will himself burn in the Fire.

From this hadith, it is understood that even a minor theft from the spoils of war is forbidden (haram), and its punishment is certainly Hellfire.
This is such a crime that even if it is committed by a mujahid, his act of jihad becomes invalid.
In any case, whether the treachery is minor or major, all are equal in the crime.
On the Day of Resurrection, such treacherous people will be publicly disgraced and humiliated in front of the entire assembly.
