Hadith 2723

حَدَّثَنَا أَبُو حَاتِمٍ ، حَدَّثَنَا ابْنُ الطَّبَّاعِ ، حَدَّثَنَا هُشَيْمٌ ، عَنْ يُونُسَ ، عَنِ الْحَسَنِ ، عَنْ مَعْقِلِ بْنِ يَسَارٍ ، قَالَ : قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي جَدٍّ كَانَ فِينَا بِالسُّدُسِ .
´It was narrated that Ma’qil bin Yasar said:` “The Messenger of Allah (ﷺ) ruled concerning a grandfather who was among us, that he should receive one sixth.”

Our esteemed researcher has declared both of the aforementioned narrations as weak in terms of their chain of transmission, and regarding the first narration, he writes that the narration of Sunan Abi Dawud (2894, 2895) suffices in its place. However, other scholars have declared both narrations to be authentic (sahih) and good (hasan). Upon detailed examination by the scholars, the view affirming the authenticity of the hadith appears to be closer to correctness.

In the absence of the deceased’s father, the one-sixth share of the father is given to the grandfather of the deceased; but if the father is present, then this one-sixth share will go to the father, and the grandfather will not receive anything.
