Hadith 2722

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، حَدَّثَنَا شَبَابَةُ ، حَدَّثَنَا يُونُسُ بْنُ أَبِي إِسْحَاق ، عَنْ أَبِي إِسْحَاق ، عَنْ عَمْرِو بْنِ مَيْمُونٍ ، عَنْ مَعْقِلِ بْنِ يَسَارٍ الْمُزَنِيِّ ، قَالَ : سَمِعْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أُتِيَ بِفَرِيضَةٍ فِيهَا جَدٌّ فَأَعْطَاهُ ثُلُثًا أَوْ سُدُسًا " .
´It was narrated that Ma’qil bin Yasar Al-Muzani said:` “I heard the Prophet (ﷺ) when a case was brought to him which involved the share of a grandfather. He gave him one third, or one sixth.”

Brief Explanation
1؎: Ahmad, Abu Dawud, and Tirmidhi have narrated from Imran bin Husayn radi Allahu anhu that a man came to the Prophet sallallahu alayhi wa sallam and said, "My grandson has died, so what will I receive from his inheritance?" The Prophet sallallahu alayhi wa sallam replied: "One-sixth." When he turned away and was leaving, the Prophet called him back and said: "One-sixth as a gesture of kindness (i.e., your actual share of the inheritance is only one-sixth, and an additional one-sixth has been given to you due to this specific circumstance)." Bukhari and Muslim have narrated the report of Hasan from Mughafal radi Allahu anhu, and regarding the grandfather, there is a difference of opinion among the Companions and later scholars. Some have considered the grandfather equivalent to the father, and sometimes he has been given one-third, sometimes one-sixth, and sometimes regarded as 'asabah (residuary heir). Some have always assigned him one-sixth. Similarly, there is a difference of opinion as to whether, in the presence of the grandfather, brothers and sisters will receive a share of the inheritance or not. A group of Companions, such as Ali, Ibn Mas'ud, and Zayd bin Thabit radi Allahu anhum, hold the view that the grandfather will share in the inheritance with the brothers, while others have said that brothers and sisters will be deprived because of the grandfather, just as they are deprived because of the father. Our esteemed researcher has declared both of the aforementioned narrations as weak in terms of their chain of transmission, and regarding the first narration, he writes that the narration of Sunan Abi Dawud (2894, 2895) suffices in its place. However, other scholars have declared both narrations to be authentic (sahih) and good (hasan). Upon detailed examination by the scholars, the view affirming the authenticity of the hadith appears to be closer to correctness.

In the absence of the deceased’s father, the one-sixth share of the father is given to the grandfather of the deceased; but if the father is present, then this one-sixth share will go to the father, and the grandfather will not receive anything.
