Hadith 2660

حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ الْأَعْلَى الصَّنْعَانِيُّ ، حَدَّثَنَا مُعْتَمِرُ بْنُ سُلَيْمَانَ ، عَنْ أَبِيهِ ، عَنْ حَنَشٍ ، عَنْ عِكْرِمَةَ ، عَنِ ابْنِ عَبَّاسٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " لَا يُقْتَلُ مُؤْمِنٌ بِكَافِرٍ وَلَا ذُو عَهْدٍ فِي عَهْدِهِ " .
´It was narrated from Ibn 'Abbas that the Prophet (ﷺ) said:` ”A believer should not be killed in retaliation for the murder of a disbeliever, and a person who has a treaty should not be killed during the time of the treaty.”

Benefits and Issues:
➊ It is the duty of Muslims to protect the life and property of non-Muslims living under the Islamic state.

➋ It is not permissible to kill a dhimmi (non-Muslim under Islamic protection) unless he commits a crime that nullifies his covenant, such as: desecration of the Noble Qur’an () or showing disrespect to the noble status of the Prophet (sallallahu alayhi wa sallam), etc.

Benefits and Issues:


The meaning of "blood being equal" is that in matters of retribution (qisas) and blood money (diyah), there is no distinction between the lowly and the noble—neither on the basis of tribes, nor on the basis of being poor or rich.
Everyone's rights are equal.
Similarly, a child and an adult are subject to the same ruling.


Muslims should be completely united against the enemy; otherwise, the entire community may suffer harm.


Muslims should help one another,
and no Muslim should maintain friendly relations with the enemy.


If even a lowly Muslim grants protection (aman) to a non-Muslim, it is obligatory for all Muslims to honor that protection.


No mujahid may keep spoils of war (ghanimah) for himself; rather, whether the spoils are little or much, he must deposit them with the commander of the army, and then receive his share accordingly.
He should not think that the commander is far away, and if I deliver this small item there, it might end up in my share anyway, so I will not deposit it with the commander and will keep it for myself.
He should not do this, but rather adhere to the principle.
