Hadith 2631

حَدَّثَنَا عَبْدُ السَّلَامِ بْنُ عَاصِمٍ ، حَدَّثَنَا الصَّبَّاحُ بْنُ مُحَارِبٍ ، حَدَّثَنَا حَجَّاجُ بْنُ أَرْطَاةَ ، حَدَّثَنَا زَيْدُ بْنُ جُبَيْرٍ ، عَنْ خِشْفِ بْنِ مَالِكٍ الطَّائِيِّ ، عَنْ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " فِي دِيَةِ الْخَطَإِ عِشْرُونَ حِقَّةً وَعِشْرُونَ جَذَعَةً وَعِشْرُونَ بِنْتَ مَخَاضٍ وَعِشْرُونَ بِنْتَ لَبُونٍ وَعِشْرُونَ بَنِي مَخَاضٍ ذُكُورٍ " .
´It was narrated from 'Abdullah bin Masud that the Messenger of Allah (ﷺ) said:` “The blood money of one who killed by mistake is twenty Hiqqah (three-year-old she camels), twenty Jadha'ah (four year old she camels), twenty Bint Makhad (one year old she camel), twenty Bint Labun (two year old she camels), and twenty Bani Makhad (one year old she camels).”

Explanation:
1:
There are three types of killing: 1- Intentional killing (qatl ‘amd):
That is, deliberately using such a weapon by which killing generally occurs.
In this case, retribution (qisas) is taken from the killer.
2. Accidental killing (qatl khata’):
That is, killing occurs by mistake.
In the above hadith, the blood money (diyah) for this type of killing is mentioned.
3. Killing resembling intentional (qatl shibh al-‘amd):
This is the type of killing in which such things are used that do not generally cause death, such as a stick or a whip, etc.
In this, aggravated blood money (diyat mughallazah) is taken, and this is one hundred camels, among which forty must be pregnant she-camels.

2:
The wealth that is given in compensation for the killing of a soul or the loss of any limb of the body is called diyah (blood money).

3:
A she-camel that has completed one year of age.

4:
A she-camel that has completed two years of age.

5:
A camel that has completed four years of age.

6:
A camel that has completed three years of age.
