Hadith 2579

حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ ، وَمُحَمَّدُ بْنُ الْمُثَنَّى ، قَالَا : حَدَّثَنَا إِبْرَاهِيمُ بْنُ أَبِي الْوَزِيرِ ، حَدَّثَنَا الدَّرَاوَرْدِيُّ ، عَنْ هِشَامِ بْنِ عُرْوَة ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ " أَنَّ قَوْمًا أَغَارُوا عَلَى لِقَاحِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَطَعَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَيْدِيَهُمْ وَأَرْجُلَهُمْ وَسَمَلَ أَعْيُنَهُمْ " .
´It was narrated from 'Aishah that :` some people raided the she-camels of the Messenger of Allah (ﷺ) , so the Prophet(ﷺ) cut off their hands and feet (on opposite sides) and lanced (gouged out) their eyes.

Benefits and Issues:

➊ Needy Muslims may benefit from the animals belonging to the public treasury (Bayt al-Mal).

➋ It is permissible, as a form of treatment, to drink the urine of those animals whose meat is lawful to eat.

➌ The punishment for apostasy is death.

➍ These criminals committed multiple crimes:

 (a) After embracing Islam, they became apostates.

 (b) They committed armed robbery.

 (c) They committed murder.

 (d) They cruelly killed the shepherds by gouging out their eyes with heated rods; therefore, the same treatment was meted out to them as retribution (qisas).

This narration is merely an abridgment of the aforementioned incident; otherwise, the Prophet (sallallahu alayhi wa sallam) did not prescribe this punishment solely for the looting of camels. In general, for those who commit armed robbery by force, more than one hand and foot may be cut off, as is mentioned in the verse regarding hirabah (armed robbery).

Imam al-Nasa'i rahimahullah heard this narration from two teachers: Muhammad ibn al-Muthanna and Muhammad ibn Bashar (Bunda). There is some difference in the wording, but the meaning in both is the same. These are the words of the teacher Muhammad ibn al-Muthanna.
