Hadith 2566

حَدَّثَنَا مُحَمَّدُ بْنُ رُمْحٍ ، قَالَ : أَنْبَأَنَا اللَّيْثُ بْنُ سَعْدٍ ، عَنْ يَزِيدَ بْنِ أَبِي حَبِيبٍ ، عَنْ عَمَّارِ بْنِ أَبِي فَرْوَةَ ، أَنَّ مُحَمَّدَ بْنَ مُسْلِمٍ حَدَّثَهُ ، أَنَّ عُرْوَةَ حَدَّثَهُ ، أَنَّ عَمْرَةَ بِنْتَ عَبْدِ الرَّحْمَنِ حَدَّثَتْهُ ، أَنَّ عَائِشَةَ حَدَّثَتْهَا ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " إِذَا زَنَتِ الْأَمَةُ فَاجْلِدُوهَا ، فَإِنْ زَنَتْ فَاجْلِدُوهَا ، فَإِنْ زَنَتْ فَاجْلِدُوهَا ، فَإِنْ زَنَتْ فَاجْلِدُوهَا ، ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ " وَالضَّفِيرُ : الْحَبْلُ .
´'Aishah narrated that the Messenger of Allah(ﷺ) said:` “If a slave woman commits fornication then whip her, and if she commits fornication then whip her, and if she commits fornication then whip her, then sell her even if that is for a rope.”

Benefits and Issues:

➊ A female or male slave cannot be given the punishment of stoning (rajm).

➋ If a female or male slave commits fornication (zina), then fifty lashes will be administered to them. The command of Allah, the Exalted, is:
﴿وَمَن لَّمْ يَسْتَطِعْ مِنكُمْ طَوْلًا أَن يَنكِحَ الْمُحْصَنَاتِ الْمُؤْمِنَاتِ فَمِن مَّا مَلَكَتْ أَيْمَانُكُم مِّن فَتَيَاتِكُمُ الْمُؤْمِنَاتِ ۚ وَاللَّـهُ أَعْلَمُ بِإِيمَانِكُم ۚ بَعْضُكُم مِّن بَعْضٍ ۚ فَانكِحُوهُنَّ بِإِذْنِ أَهْلِهِنَّ وَآتُوهُنَّ أُجُورَهُنَّ بِالْمَعْرُوفِ مُحْصَنَاتٍ غَيْرَمُسَافِحَاتٍ وَلَا مُتَّخِذَاتِ أَخْدَانٍ ۚ فَإِذَا أُحْصِنَّ فَإِنْ أَتَيْنَ بِفَاحِشَةٍ فَعَلَيْهِنَّ نِصْفُ مَا عَلَى الْمُحْصَنَاتِ مِنَ الْعَذَابِ﴾ Translation:
And whoever among you does not have the means to marry free believing women, then (he may marry) from those whom your right hands possess among your believing slave girls. Allah knows best about your faith; you are from one another. So marry them with the permission of their people, and give them their due compensation according to what is reasonable, (they should be) chaste, not those who commit fornication openly, nor those who take secret lovers. Then when they are taken in marriage, if they commit indecency, then upon them is half the punishment that is upon free women.

➌ The wisdom behind not giving the death penalty to a slave (male or female) is that in such a case, the master would suffer loss, even though he is not a partner in the crime.

➍ A male or female slave is not exiled. The form of exile for them is that they are sold to another master, so that their environment changes and they refrain from this sin.
